Any regular traveler may one day find themselves faced with a cruel billboard:“Delayed flight”, even“Flight canceled”.

Often, some explanations are provided – bad weather conditions, technical problems, aircraft rotation – but, even more often, passengers are left in total limbo, without real information or assistance.

Gold,this silence should never mean resignation.

European law has precisely provided for such situations and has, since theRegulation (EC) No. 261/2004, astrong protection of air passengers. In other words, if your flight from or to the European Union is canceled, delayed by more than three hours, or if you are denied boarding,you are entitled to lump sum compensation of up to €600.

 1. Who is protected?

The European Regulation applies:

  • hasany flight departing from an airport located in the European Union, whatever the airline;
  • and toany flight to the European Unionwhen operated by an EU company (Brussels Airlines, Air France, Lufthansa, etc.).

In other words, if you leave Brussels, Paris, Madrid or Lisbon, or if you return from Africa or America with a European carrier,your rights are guaranteed.

2. When is compensation due?

Two main conditions must be met:

  • Your flightarrives at destination with a delay of at least three hourscompared to the planned schedule;
  • Or he wascanceled less than fourteen days before departure, without valid justification (for example, outside of a duly established case of force majeure).

The compensation is fixed according to the distance of the flight:

  • €250for flights of less than 1,500 km,
  • €400for intra-European flights or from 1,500 km to 3,500 km,
  • €600for flights over 3,500 km (for example, a Brussels–Douala or a Paris–Kinshasa).

 3. In addition to compensation: your expenses must be reimbursed

The cancellation or prolonged delay of a flight often results inunexpected expenses: hotel nights, meals, transfers, professional losses, etc.

The airline is required tocover or reimburse these costs, upon presentation of supporting documents.

In other words,no expenses imposed by the fault of the carrier must remain your responsibility.
